These Terms & Conditions (“Terms”) govern the use of the website https://wildtrailsbuggies.com/ and all bookings, tours, and services offered by Wild Trails Buggies (“Company,” “we,” “our,” or “us”).

By accessing our Website, making a reservation, or participating in any tour, you confirm that you have read, understood, and agreed to these Terms, as well as our Privacy Policy and Refunds & Cancellations Policy, which form an integral part of this agreement.

1. Company Information

Wild Trails Buggies is a tour operator based in Punta Cana, Dominican Republic, offering guided off-road buggy tours and related experiences.

2. Eligibility & Acceptance of Terms

• You must be at least 18 years old to make a booking.

• By booking on behalf of others, you confirm you have authority to accept these Terms for all participants.

• Participation in tours may require meeting age, health, or safety requirements.

3. Bookings & Payments

• All bookings are subject to availability.

• A reservation is considered confirmed only upon full payment and issuance of a confirmation email.

• Prices are shown in the currency displayed at checkout and may include applicable taxes or fees.

• Wild Trails Buggies reserves the right to correct pricing errors or refuse bookings in case of fraud or system error.

4. Tour Participation & Safety

• Participants must follow all instructions provided by guides and staff.

• Wild Trails Buggies reserves the right to deny participation to any individual who:

  • Appears under the influence of alcohol or drugs

  • Behaves in a dangerous, aggressive, or disruptive manner

  • Fails to comply with safety rules

No refunds will be issued in such cases.

5. Health & Physical Requirements

• Some tours involve physical activity and inherent risks.

• Customers are responsible for assessing their physical condition before participating.

• Pregnant individuals or persons with serious medical conditions should not participate unless explicitly approved.

Participation is at the customer’s own risk.

6. Cancellations & Refunds

(Aligned with Refunds & Cancellations Policy)

All cancellations, refunds, no-shows, weather conditions, and company-initiated cancellations are governed exclusively by our Refunds & Cancellations Policy, which is incorporated by reference into these Terms.

Key points include (non-exhaustive summary):

• Full refunds for cancellations made 48 hours or more before the tour

• Partial refunds for cancellations made 24–47 hours before the tour

• No refunds for cancellations within 24 hours, no-shows, or late arrivals

• Refunds processed to the original payment method within 5–10 business days

In the event of any conflict, the Refunds & Cancellations Policy prevails.

7. Weather & Force Majeure

• Tours operate rain or shine, unless conditions are deemed unsafe.

• Wild Trails Buggies is not responsible for cancellations, delays, or changes caused by:

  • Severe weather

  • Natural disasters

  • Government actions

  • Public health emergencies

  • Other force majeure events

In such cases, remedies are limited to those outlined in the Refunds & Cancellations Policy.

8. Liability Disclaimer

To the fullest extent permitted by law:

• Wild Trails Buggies is not liable for:

  • Personal injury

  • Property damage

  • Loss, theft, or delay

• Participation in tours involves inherent risks, including accidents and environmental conditions.

Customers may be required to sign a liability waiver prior to participation.

9. Limitation of Liability

Wild Trails Buggies’ total liability, if any, shall not exceed the amount paid by the customer for the specific tour giving rise to the claim.

This limitation applies to claims based on contract, negligence, or otherwise, to the extent permitted by Dominican law.

10. User Conduct

You agree not to:

• Misuse the Website

• Attempt unauthorized access

• Provide false or misleading information

• Interfere with site operations or security

Violations may result in suspension of access or cancellation of bookings without refund.

11. Intellectual Property

All Website content, including text, images, logos, videos, and branding, is the property of Wild Trails Buggies or its licensors and may not be used without prior written consent.

12. Privacy & Data Protection

Personal data is processed in accordance with our Privacy Policy and Dominican Republic Law No. 172-13.

By using the Website or booking services, you consent to such processing.

13. Third-Party Services

Wild Trails Buggies is not responsible for the content, policies, or practices of third-party providers.

14. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Dominican Republic.

Any disputes shall be subject to the jurisdiction of the competent courts of the Dominican Republic, without prejudice to consumer rights under applicable law.

Wild Trails Buggies reserves the right to update these Terms at any time.
